1. Acceptance of Terms

By downloading, installing, or using the Earlybit application ("App") from the Apple App Store, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

Your use of the App is also subject to Apple's Licensed Application End User License Agreement (Standard EULA) and the Apple Media Services Terms and Conditions, which govern App Store downloads, in-app purchases, and subscriptions.

2. Description of Service

Earlybit is a morning alarm app for iPhone and iPad that helps you stop snoozing by requiring a wake mission before the alarm can be dismissed. The App may allow you to:

  • Set and schedule morning alarms with loud alerts and optional gradual volume ramp (Pro)
  • Complete wake missions such as math puzzles, shake-to-wake, photo capture, step counting, typing phrases, memory challenges, and QR code scanning
  • Track consecutive morning streaks and view wakeup receipts you can share
  • Access optional sleep insights and Apple Health sync where enabled
  • Use native iOS alarm features including AlarmKit on supported devices and iOS versions
  • Upgrade to Earlybit Pro for unlimited alarms and premium mission types

The App is for personal wellness and productivity purposes. It is not a medical device and does not provide medical, sleep-disorder, or professional health advice.

3. Apple App Store & Device Requirements

  • The App is distributed exclusively through the Apple App Store
  • You must comply with Apple's App Store Review Guidelines and applicable iOS usage rules
  • Core alarm features require notification permission; mission types may require camera, motion, or Health access as described in the App and Privacy Policy
  • Alarm reliability depends on your device settings, Do Not Disturb / Focus modes, battery level, and iOS version
  • We do not guarantee that alarms will fire in every device state (for example when the device is powered off or notifications are disabled)

4. Accounts and Data

  • Earlybit does not require email, Apple Sign In, or password registration
  • An anonymous account may be created in the background to support subscriptions and optional cloud sync; you never see a sign-in screen
  • Alarm schedules, streaks, preferences, and mission history are stored primarily on your device
  • You are responsible for maintaining your device and keeping notifications enabled for reliable alarms
  • We do not guarantee recovery of local data after uninstalling the App or resetting your device
  • You may clear local data from Settings inside the App where available

5. Wake Missions & Permissions

  • Math and shake missions use the screen and device motion sensors
  • Photo and QR missions require camera access when you choose those mission types
  • Step missions may use motion and fitness data from your device
  • Optional wearable sync reads sleep and step data from Apple Health only after you grant HealthKit permission
  • You can decline optional permissions; some mission types or features may be unavailable without them
  • Do not use camera or QR missions to record others without consent where required by law

6. Subscriptions & In-App Purchases (Apple)

Earlybit Pro is offered as an auto-renewable subscription through Apple In-App Purchase:

  • earlybit_pro_monthly — monthly subscription
  • earlybit_pro_yearly — annual subscription, which may include a free trial period as shown in the App
  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period
  • Your account is charged for renewal within 24 hours prior to the end of the current period at the price shown in the App
  • Manage or cancel subscriptions in Settings → [Your Name] → Subscriptions on your iPhone or iPad
  • Use Restore Purchases on the paywall or in Settings after reinstalling or switching devices
  • Free trials convert to paid subscriptions unless cancelled before the trial ends
  • Any unused portion of a free trial is forfeited when you purchase a subscription where applicable
  • Refunds are handled by Apple according to App Store policies; contact Apple Support for billing disputes

7. Privacy and Third-Party Services

Your use of the App is also governed by our Privacy Policy. The App may integrate with services such as:

  • Firebase (Google) for analytics, anonymous authentication, remote configuration, and optional cloud sync
  • Adapty for App Store subscription and purchase management
  • Sentry for crash and error monitoring
  • Apple frameworks including UserNotifications, HealthKit, and AlarmKit where applicable

On iOS, App Tracking Transparency may be presented before analytics that could be used for tracking across apps and websites owned by other companies.

8. Disclaimers and Limitations

  • The App is provided "as is" without warranties of any kind to the fullest extent permitted by law
  • We do not guarantee that you will wake on time, break snooze habits, or achieve specific health outcomes
  • Apple is not responsible for the App or its content; Apple has no obligation to provide maintenance or support for the App except as required by applicable law
  • Our liability is limited to the maximum extent permitted by law
  • Total liability shall not exceed the amount you paid for the App or in-app purchases in the twelve (12) months before the claim, if any

9. Updates and Termination

  • We may release updates to improve alarms, missions, security, and iOS compatibility
  • We may modify these Terms; continued use after changes may constitute acceptance where permitted by law
  • You may stop using the App at any time; uninstalling removes local data unless backed up elsewhere
